CHILDREN OF DIVORCE ~ The Greatest Taboo?

In 2002, I "successfully" represented myself for almost 3 years in my divorce and for our son. I became knowledgeable in Family Court litigation and I believed then that in Family Courts all of the lawyers and Judges were  driven to serve Justice and protect the best interests of my child, family, and therefore, unconsciously participated in the court proceedings for my daughter Zoraya. 

Later on when my Paternity Suit started in 2008, I learned that these proceedings, the Lawyers and Judges that drive to serve Justice were nothing short of a swindle. 

I have observed countless families needlessly damaged and financially exploited by this system. 

Predictably, my efforts to reform the system were answered by government retaliation of my civil rights and fundamental human rights causing career damage, intentional and negligent emotional distress, and child abuse upon my daughter. Reported and ignored!! 

When families are compelled by law into court for dispute resolution, their members do not realize how much child-rearing freedoms they surrender to outsiders. The arbitrary mandate of naming a “custodial parent” begins the damaging process.

I AM A DEDICATED FATHER WITHOUT COMMISSION OF ANY CRIME OR UNFIT PARENTING.

The first case to recognize a non-custodial parent’s cause of action based on the tort of intentional infliction of emotional distress was Sheltra V. Smith, 392 A. 2d 431 (Vt. 1978). In this case, the non-custodial parent brought suit for damages alleging that:

“defendant willfully, maliciously, intentionally, and outrageously inflicted extreme mental suffering and acute mental distress on the plaintiff, by willfully, maliciously, and outrageously rendering it impossible for any personal contact or other communication to take place between the (plaintiff and child).”  ~Id. at 433.

False accusations (or groundless accusations or unfounded accusations or false allegations or false claims) can be in any of the following contexts:

Types

When there is insufficient supporting evidence to determine whether an accusation is true or false, it is described as "unsubstantiated" or "unfounded". Accusations that are determined to be false based on corroborating evidence can be divided into three categories:
  • An allegation that is completely false in that the events that were alleged did not occur;
  • An allegation that describes events that did occur, but were perpetrated by an individual who is not accused, and in which the accused person is innocent.
  • An allegation that is partially true and partially false, in that it mixes descriptions of events that actually happened with other events that did not occur.
A false allegation can occur as the result of intentional lying on the part of the accuser; or unintentionally, due to a confabulation, either arising spontaneously due to mental illness or resulting from deliberate or accidental suggestive questioning, or faulty interviewing techniques. Researchers Poole and Lindsay suggested in 1997 applying separate labels to the two concepts, proposing the term "false allegations" be used specifically when the accuser is aware they are lying, and "false suspicions" for the wider range of false accusations in which suggestive questioning may have been involved.

Rape

The statistics on false accusations of rape vary widely, from 2% to Eugene Kanin's (1994) figure of 41%, which derived from a case study of a police agency in a metropolitan city in the Midwest. John Bancroft states that a search of the literature on false rape reports reveals that Kanin's figure of 41% false rape reports is regarded as unusually high. FBI statistics for the annual rate of false reporting of forcible assault across the country have been a consistent 8%. A study from the UK found that of the approximately 14,500 cases of rape reported in 2005/2006 9% were classified as false allegations.

Child abuse

A false allegation of child sexual abuse is an accusation that a person committed one or more acts of child sexual abuse when in reality there was no perpetration of abuse by the accused person as alleged. Such accusations can be brought by the victim, or by another person on the alleged victim's behalf. Studies of child abuse allegations suggest that the overall rate of false accusation is under 10%, as approximated based on multiple studies. Of the allegations determined to be false, only a small portion originated with the child, the studies showed; most false allegations originated with an adult bringing the accusations on behalf of a child, and of those, a large majority occurred in the context of divorce and child-custody battles.

Workplace bullying

Research by the Workplace Bullying Institute, suggests that "falsely accused someone of 'errors' not actually made" is the most common of all bullying tactics experienced, in 71 percent of cases.

Workplace mobbing

Main article: Workplace mobbing
Workplace mobbing can be considered as a "virus" or a "cancer" that spreads throughout the workplace viagossiprumour and unfounded accusations.

Münchausen syndrome by proxy

The case has been made that diagnoses of Münchausen syndrome by proxy, that is harming someone else to get attention for yourself, are often false or highly questionable.

Stalking

In 1999, Pathe, Mullen and Purcell wrote that popular interest in stalking was promoting false claims. In 2004, Sheridan and Blaauw said that they estimated that 11.5% of claims in a sample of 357 reported claims of stalking were false.

Narcissistic rage

Main article: Narcissistic rage
Rage by a narcissist is directed towards the person that they feel has slighted them. This rage impairs their cognition, therefore impairing their judgment. During the rage, they are prone to shouting, fact distortion and making groundless accusations.

Psychological projection

Main article: Psychological projection
Psychological projection can be established as a means of obtaining or justifying certain actions that would normally be found atrocious or heinous. This often means projecting false accusations, information, etc., onto an individual for the sole purpose of maintaining a self-created illusion.

Men’s and fathers’ groups saw the case in a different light, however. To them, it reflected a phenomenon that they see all too frequently – the elimination of fathers from their children’s lives by unmitigated, unscrupulous demands on the children’s loyalty on the part of the mother with custody, along with the unremitting denigration and belittling of the father.

“Custody” and “placement” (sometimes called “visitation”) are often confused by the uninitiated. “Custody” has to do with decision-making on the child(ren)’s behalf on matters of health, education, and financial management. “Visitation” has to do with where the children live and when they, in accordance with the judge’s order, are and are not scheduled to be there.
The judge decides who will be primarily in charge of the child(ren)’s health, education and finances, and with whom the children will primarily live. The decision is made after the judge hears from professionals and various other observers and acquaintances who are familiar with both parents and the child(ren), as well as the dynamics of the respective family household. First among the professionals, as determined by state law, is the guardian ad litem (who may be a lawyer) or the custody evaluator (who may be a psychologist). Depending upon the state, one or another of these professionals is appointed by the court to look into the specific situation presented by each case and make a recommendation to the judge as to the “best interests of the child(ren)” in that case.
In recent years, as more and more mothers have entered the workforce, child custody fights between divorcing parents have become more commonplace. The outcomes of these contests are ultimately decided by a Family Court judge whose determination is based on his/her answer to the following question: “primary placement with which parent is in the best interests of the child(ren)?”

Being a good dad means both talking the talk and walking the walk. Everyone from the ex to the kids to the guardian to teachers, coaches, neighbors, doctors and shrinks is watching. Show them all what a good dad you are and in the process you’ll actually become a better dad than you were. The inevitable effect of that is that it’s good for you and your children, and smart dads know this. Take this expert advice to heart, and remember: if you want custody of your children, show the world and your family that you are serious about the responsibilities of fatherhood.

While it is true our family courts must do more to move toward shared parenting whenever there is a divorce or separation in a family

Bad Judges - 2015Judges are allowed to make numerous errors that litigants pay tens of thousands of dollars to correct through the appellate process or either live with illegal orders. Judges make intentionally erroneous orders with the knowledge litigants don’t have the resources to correct. If a cashier, nurse or any other profession made as many errors as judges they would be terminated. It is time judges are judge by the same standards the litigants standing before them are judges.

Presiding Judge of my ""8"" YEAR-OLD  "simple" Paternity - Family Court Case from 2008!



 The 5th Judge to preside over my simple case; an unwed biological father seeking to maintain contact with his daughter Zoraya (Google ‪#‎StandupforZoraya‬ to read about this case) and Judge Manno-Schurr is enabling Child Abuse via Parental Alienation.


On March 25th, 2015, in a special set hearing at the Family Courthouse, Judge Manno-Schurr interrupted my testimony while on the witness stand to notate the court reporter's record as follows; "the father (me) is turning red in the face, yelling at me, and pointing his finger at me". My attorney, Stuart Abramson, objected noting the record as follows; "the father has been diagnosed with PTSD your honor". Then Judge Manno-Schurr (this is why you should rethink this article) said; "Mr. Inguanzo were you in the military?"

My response: "NO!  Your Honor ...  'YOU' AND THIS CASE HAS CAUSED THE PTSD ACCORDING TO MY DOCTORS"

How about that for a Registered Nurse!!!

Judges re-abuse children worsethan abusers


When someone hurts us and/or our children, our first reaction is to protect ourselves or to call the police.  We think that as victims that the authorities should be there to help us; that as innocent victims the police, and court system should there for the best interest of the innocent.  In fact, in many cases the exact opposite is true.  Over the years a growing amount of judges and authorities are siding with the abusers and only blaming and re-victimizing the victims.
