Family Court - Source of the Corruption?

A former elementary school teacher and her father pleaded guilty Thursday to their admitted roles in a plot to murder her former husband because they were unhappy with a child-custody award in the couple’s divorce case.
Then, after onetime third-grade teacher Kathleen Dorsett was arrested in the 2010 slaying of Stephen Moore, her mother, Lesley Dorsett, met with the jailed woman to plot the slaying of the dead victim’s mother, according to theAsbury Park Press and the Associated Press.
“The goal was to kill (her) because we were afraid she was going to testify,” Lesley Dorsett told a New Jersey judge during a hearing in Freehold. The Dorsetts also were reportedly unhappy because Evlyn Moore was awarded custody of her young granddaughter after the murder of her son.
However, Evlyn Moore was not harmed and attended Thursday’s court hearing. “I’m as satisfied today as I will ever be,” she told reporters afterward. “I feel that Stephen has gotten justice today.”
Lesley Dorsett, a former member of the Ocean Township school board, pleaded guilty Thursday to conspiracy to commit murder. Her husband and daughter pleaded guilty to murder and other charges.
The plot unraveled after Lesley Dorsett handed over an envelope filled with cash to the hit man she thought she was hiring to kill Evlyn Moore. In fact, he was an undercover cop who had been tipped by Kathleen Dorsett’s cellmate, according to the newspaper articles.
Prosecutors are expected to recommended an eight-year prison term for Lesley Dorsett, and 58 years, with no parole for at least 51 years, for her 38-year-old daughter, when the two are sentenced in August along with Thomas Dorsett, 66. He faces a potential 50-year sentence, with no parole for 30 years.

Any parent who is deprived of his or her child, even though temporarily, suffers grievous loss.


Such loss deserves extensive due process protection.




According to attorney Rachelle E. Hill, of Bean, Kinney and Korman, and a judge, that is precisely the claim. Their lawyer has written the offices of A Voice for Men to demand that we remove a post from the forums containing the note.
It is not going to happen.
The text of the note was posted to our forums months ago. We considered doing a feature story on it at the time, but opted not to because we had no credible corroboration that the story was factual.
Attorney Hill, her law firm, and the suicide victim’s former wife have now resolved that matter to our satisfaction. The demand letter itself is sufficient for us to believe that the following note is genuine.*

Interest

Legal abuse refers to abuses associated with both civil and criminal legal action. Abuse can originate from nearly any part of the legal system, including  frivolous  and  vexatious  litigants,  abuses by law enforcement,incompetent, careless or corrupt attorneys and misconduct from the judiciary itself.

Legal abuse is responsible not only for injustice, but also harm to  physical,  psychological  and  societal health.*

Types~

Abuses can originate from virtually every part of the legal system. Litigantsattorneyslaw enforcement andjudiciary can abuse the system, sometimes accidentally but more often intentionally. Legal abuse can also besystemic, such as when the principles, processes, and consequences of law itself encourage and enable individuals to legally harm others.

Abusive litigants~



Abusive litigants in civil cases are most often classified as vexatious litigation, frivolous litigation, or both. Avexatious litigant seeks to harass or subdue an adversary. A frivolous litigant starts or carries on actions that have little or no merit and are very unlikely to be won. Litigants of this sort are often unable to find representationwilling to accommodate them and thus must represent themselves in propria persona.
There can often be considerable overlap between these two types of abuse. One case in point is the strategic lawsuit against public participation (SLAPP), which is a lawsuit intended to censor, intimidate and silence critics by fear, intimidation and burdening them with the cost of a legal defense until they abandon their criticism or opposition. Such actions are self-evidently vexatious, but are typically frivolous as well in that the plaintiff does not expect, or even intend, to win.
Litigants can abuse the system in criminal ways as well. Some of the forms of criminal legal system abuse arejury tampering, the practice of directing enticements or threats to jurors in order to influence their deliberations, and falsification of evidence, which refers to any of a variety of ways evidence is improperly manipulated. One particular case of falsifying evidence is the frameup, a chiefly American term for the manufacture or manipulation of evidence for the purpose of indicating the guilt of an innocent party.

Law enforcement abuse~

There are a plethora of ways that police and law enforcement can undermine the rights of citizens. Sometimes such abuses are unintentional, brought about by circumstance, imperfect understanding of some subtlety of law, or other kinds of good-faith mistakes. In other cases rights are abused deliberately, due to prejudice, self-interest, vigilantism, impaired value judgmentconflicts of interest or corruption. Such police misconduct can take many forms, among them false arrestharassmentpolice brutalityfalsification of evidencecoercion and in rare cases, torture and false imprisonment.

Abusive advocates~

Lawyersparalegals and other professionals involved in legal advocacy can abuse the system in a number of ways. In some cases, representation may well-intended but nonetheless incompetent. In others, lawyers engage in misconduct in an effort to gain unfair advantage for their clients or in pursuit of some self-interest.

Abusive judiciary~

Abuse from the bench can arise from various causes, including incompetence, conflicts of interestbias or prejudice, judicial misconduct and corruption.

Consequences of abuse~

Although the primary consequence of unaddressed legal-system abuse for victims is injustice, abuses of the legal system inflict harm in many other ways. Civil litigation and criminal defense of the innocent imposepsychological stress, often severe, upon the parties involved. Often such stress will affect physical health as well. When the system is abused and justice is denied as a result, stress and its effects can be exacerbated enormously. Karin P. Huffer, M.S., M.F.T. hypothesized the condition Legal Abuse Syndrome (LAS) as a form ofpost traumatic stress disorder (PTSD) caused by ethical violation, legal abuse, betrayalabuse of powerabuse of authority, lack of accountability and fraud.
Chronic and high-profile legal abuse have societal effects as well, including distrust of the law, law enforcement and the legal system, rationalization of small crimes by ordinarily honest citizens, and psychological stress.

I Was Falsely Accused of Domestic Violence...Now My Child Suffers


October is Domestic Violence Awareness Month.


The Violence Against Women Act provides grants to state and local law-enforcement agencies, prosecutors, and courts to establish and enforce domestic violence laws and policies. But there is a growing belief that many of these policies are harmful to victims and give rise to false allegations


October is Domestic Violence Awareness Month. Despite the new VAWA Inclusion Mandate, some DV organizations are still denying the extent of abuse for certain victim groups, and ignoring the problem of mutual violence altogether.

SAVE worries these factual biases may turn Domestic Violence Awareness Month into DV "Un-Awareness" Month. Join SAVE's Trick or Truth campaign so the American public learns the truth of domestic violence!

We want to contrast the new VAWA Inclusion Mandate (highlighted on the SAVE home page) and Sen. Leahy's mantra, "A victim is a victim is a victim," with the biased statements on the NNEDV fact sheet.

Dr. Bill Bernet, lead a group of interested professionals in encouraging the DSM 5 editing group to include Parental Alienation Disorder. The new DSM  was published on May 18, 2013 and is the reference book for psychiatrists, psychologists and other mental health providers  Here is Dr. Bernet's unedited analysis of the result.

Finally, DSM-5 was published today.  The DSM-5 Task Force told us 2 or 3 years ago that they did not want parental alienation to be a separate diagnosis in DSM-5, but they thought that parental alienation could be considered an example of other diagnoses that are in DSM-5.

The actual words "parental alienation" are not in DSM-5, but there are several diagnoses that can be used in these cases.  I would say the "spirit" of parental alienation is in DSM-5, even if the words are not.

Parent-child relational problem now has a discussion in DSM-5, not just a label.  The discussion explains that cognitive problems in parent-child relational problem "may include negative attributions of the other's intentions, hostility toward or scapegoating of the other, and unwarranted feelings of estrangement."  That is a pretty good description of a child's view of the alienated parent, although it is an unfortunate use of the word "estrangement."

Child psychological abuse is a new diagnosis in DSM-5.  It is defined as "nonaccidental verbal or symbolic acts by a child's parent or caregiver that result, or have reasonable potential to result, in significant psychological harm to the child."  In many instances, the behavior of the alienating parent constitutes child psychological abuse.

Child affected by parental relationship distress is another new diagnosis in DSM-5.  It should be used "when the focus of clinical attention if the negative effects of parental relationship discord (e.g., high levels of conflict, distress, or disparagement) on a child in the family, including effects on the child's mental or other physical disorders."  That is also a good description of how parental alienation comes about.

Factitious disorder imposed on another is the DSM-5 terminology for factitious disorder by proxy or Munchausen disorder by proxy.  Its definition is "falsification of physical or psychological signs or symptoms, or induction of injury or disease, in another, associated with identified deception."  In some cases, that would describe the behavior of the alienating parent.

Delusional symptoms in partner of individual with delusional disorder is the DSM-5 terminology for shared psychotic disorder or folie a deux.  The definition is: "In the context of a relationship, the delusional material from the dominant partner provides content for delusional belief by the individual who may not otherwise entirely meet criteria for delusional disorder."

In discussing this topic, I would say that the concept of parental alienation is clearly in DSM-5, although the actual words are not.  This is a great improvement over DSM-IV-TR, especially with the addition of the new diagnoses, child psychological abuse and child affected by parental relationship distress.
